RULES OF USE AND BEHAVIOR OF THE FACILITY AND SPORTS CLUB.

  • Participants must bring their swimsuit from home. We do not have changing rooms or bathrooms, only the terrace with shade, benches and closed.
  • For most of the activities you will need a swimsuit, sunscreen, flip-flops, towel, water, change of clothes and a backpack to store your belongings.
  • You should come hydrated and having eaten something.
  • Shoes must be worn indoors and without sand.
  • All soft material is disinfected with 100% biodegradable detergent.
  • We are not responsible for the loss or theft of valuables.

We have a cabinet to leave the backpacks of the participants of the private courses and trainings or group leaders.

Groups leave their backpacks outside in the shaded area with a group leader or on our terrace in case of small groups or if there are only a few leaders and whenever possible.

  • Reservations must be made in advance on the app or fill out forms, in case of groups via WhatsApp or email.
  • Do not enter with sand.
  • By booking both individuals and groups, they declare that they are aware of the activities of the sports club and their risks, that the participant/s do not suffer from infectious diseases, or any limitation that would prevent them from participating in the activities.
  • Take care of the material and deliver it without sand.

Cancellations

  • Once the service has been paid, the amount will not be refunded, unless the course is cancelled due to conditions external to the school (such as bad sea conditions or lack of instructors).
  • Cancellations can be made up to 2 hours before the paid service, without the right to a refund, generating a voucher to be redeemed in another course or rental with 1 month of validity.
  • Within 2 hours prior to the service, the cancellation will be 100%, with no option to change, no bonus, no refund.
  • Summer camps.
  • In monthly fee, in the same month, after the third session of enrollment and no-show without notice, the fee will be cancelled without refund or compensation.
  • Summer Camps:

Money is not refunded, unless it is impossible to perform the activity during the whole summer due to medical justification. In all other cases you can only change the week (which has availability) by giving at least one week’s notice (7 days before, the Monday before the contracted week).

Neither can single days be made up for non-attendance. Neither can split weeks be made up.

If a participant needs any special attention, we need to know about it in order for the group and the monitors to function properly.

If you need an invoice, it must be indicated at the time of making the reservation through emial hola@escueladesurflatermica.es.

RULES and CONDITIONS OF MATERIAL USE. CONDITIONS FOR ALL ACTIVITIES AND TYPES OF CLIENTS OF THE SPORTS CLUB:

  • The holder of the individual use must be over 18 years of age and will be responsible for the equipment. The person using the material must have experience in the activity. If he/she does not have it, he/she or his/her companions will be responsible for his/her behavior and possible damages to him/herself or to third parties, exempting the school from any responsibility. They must also have a National Identity Card or Passport.
  • Payment for the use of the equipment shall be made in advance in cash, for the total amount of the service and at the time of pick-up.
  • A deposit of 20 € or 30 €, in cash, per team, may be required from NON-members, which will be returned upon delivery of the used equipment if there is no replacement cost or other additional charge.
  • Reservations, availability inquiries or any other communication should be made by telephone (0034 684 297 409). Availability of material is not guaranteed without prior reservation.
  • The data provided by the user will be used exclusively for the correct provision of the contracted service, being able to request, in accordance with the law, access, rectification, cancellation or opposition by communicating by any means to the club.
  • The user declares to be in perfect health and with the necessary conditions for the practice of this sport. You must take into account our recommendations according to your level and the conditions of the beaches.
  • The material will be picked up at the place established by the user and will be returned on the date, time and place agreed by the club and the person using it. Serious non-compliance with the schedule will result in a surcharge of half a day's extra rental (15 €). The delivery before the end of the use will not cause any kind of credit or refund.
  • The user is responsible for being insured with adequate coverage against risks that may arise during the period of use of the equipment. The sports club is not responsible for claims for accidents, injuries, blows or damages caused to itself or to third parties (persons or property) during the rental period.
  • The user is obliged to take good care and take all necessary precautions to protect the material. E.g. Do not leave it face up in the sun; Do not sit on the material on the sand/rock, etc.
  • It will not be possible to remove the material from the school beach (La Misericordia).
  • The material must be returned clean and rinsed.
  • It is forbidden to transfer, sell or exchange the leased equipment.
  • Members have special prices.
  • The sports club may unilaterally terminate the contract before the date of its conclusion in case of serious breach by the user in the use and care of the material. In this case the club may take immediate possession of the material in the place where it is located, without the user being entitled to any claim or compensation.
  • The user may extend the duration of the use of the equipment by notifying the club in the aforementioned ways, prior to the date determined by the club.
  • The user expressly agrees to pay to the club the charges corresponding to the prices of the current rates specified on the website and bulletin board for the time of disposal of the material, which include legally applicable taxes, as well as the costs of replacement or any other addition mentioned above and membership fee (for non-members).
  • The user shall be responsible for all legal costs arising from the non-compliance by the user of the obligations established in the present use of the material.
  • The material will be returned in the same conditions of delivery, if not, the user must report the damage occurred. The following replacement costs imposed by the club are established and accepted by the user in order to use the material:

TABLES

Major damage or breakage, loss or theft will result in a 200 € charge for any type of board.

Partial damages, such as holes, dents, etc. They will be assessed according to damage (10 € – 150 €).

It is forbidden for 2 people to get on. Except in Paddle an adult and a child under 8 years old or in an activity led by a monitor. The deposit will be withdrawn if it is violated.

INVENTS

Loss or theft will result in the payment of 25 €.

Breakage of invention/mooring or minor damage. They will not imply extra payment since they are supposed to be a consequence of the usual use of the equipment.

QUILLS

Breakage, slight deterioration or loss of keels, depending on the damage (5 € – 30 €). In most cases, the payment will correspond to the replacement of the keels.

NEOPRENE

Major breakage or major damage (zipper), loss or theft will result in a 100 € charge.

Partial deterioration is assumed to be a consequence of use.

BODYBOARDS and BODYBOARDS

Major damage or breakage, loss or theft will result in a 60 € charge.

Partial deterioration (such as holes, “wrinkles”,…) valuation according to damage (10 € – 80 €)

REMOS

Breakage or deterioration, loss of one or both pairs, or theft will imply a 35 € charge.

Partial deterioration (such as holes, dents,…) valuation according to damage (5 € – 50 €).

  • By using the material, the user declares to have read and accepted the above conditions.
  • The place of jurisdiction for this contract is Spain.
  • For all activities that take place in the club in which the participant is registered through the web form, expressly authorizes the surf club conoce tu mar (La Escuela la Termica) to use photographs, videos or any other means of reproduction in which the person whose data appear in the completed form, by including your image on the website of the company, brochures or other promotional media in order that you can have easy access to them, as well as a means of advertising. By submitting the form, you indicate that you agree with all the legal notice and data protection policy described on the website.

  • Cancellation/Return Policy

No refunds will be accepted once the period to which the payment refers has started. Before the order begins, you can notify us through the app messaging system and the refund will be made within a maximum of 30 working days by the same payment method you used.
